Rangers to appear in court tomorrow as £9.5million pound legal battle heats up

RANGERS are scheduled to appear in court tomorrow morning to contest the latest step in a multi-million pound action.

Elite Sports Ltd, a firm linked with former kit supplier Hummel sportswear, is suing Gers for more than £9.5million in lost sales.

They were ordered to pay a £350,000 bond back in May to cover the Glasgow club’s legal costs before the case was allowed to go any further.

But the case has now appeared on the official rolls for the Court of Session, where a pre-proof hearing is scheduled to go ahead under Lord Braid tomorrow morning.

The case is expected to take eight days.

That £9.5m figure was detailed in paperwork lodged by briefs representing the sports brand last year.

It’s understood the loss is connected with sales at stores on Argyle Street in Glasgow, a store in Belfast and online.

The court was told how Rangers entered into the contract in September 2018 and a decision by a court in London just six weeks later resulted in the Glasgow club “not performing” in the agreement.

During the May hearing, Gavin McCall KC, representing Rangers, asked Lord Braid for the bond to be paid.

He said: “The previous expert appointed has carried out work and has been paid £120,000.

“A new expert has now been identified and they will pick up the work and carry out additional work and will produce a further financial report to the court and the cost for doing so is £150,000.

“On top of this there will be a joint expert meeting and a further consultation which will cost £50,000.”

As well these costs their lawyer fees are expected to reach £200,000 and up to £40,000 for their expert witness from Ernst & Young to attend the hearing. David Thomson KC who is representing Elite said the request was “excessive.”

He added: “The motion for further finance is opposed.

“In March the sum sought was £180,000.

“Now they want £440,000. This is a significant increase.”

However Lord Braid ordered that £350,000 to be paid over two instalments.

In October 2018 it was ruled Rangers breached the terms of an agreement made with a company in the Sports Direct group.

In that judgement Mr Justice Teare concluded the Ibrox club made a new agreement with Elite Sports Ltd, believed to be worth £10million, without giving Sports Direct a chance to match that firm’s offer.

Despite this ruling the Gers started a new contract with their current kit supplier, Castore, in October 2020.
